Common Reasons for a Georgia License Suspension

The reason for a suspension determines which deadlines, agencies, and court proceedings may apply. A DUI-related Administrative License Suspension is handled through the Georgia Department of Driver Services and is separate from the criminal DUI case.

License suspension issues commonly arise from:

  • A DUI Arrest: An arrest can trigger the Administrative License Suspension process before the criminal charge is resolved.
  • Accumulated Traffic Points: Georgia assigns 2 to 6 points for traffic convictions. Accumulating 15 or more points during a consecutive 24-month period results in suspension.
  • Rules for Younger Drivers: Drivers under 18 face suspension after accumulating 4 or more points within 12 months. A driver under 21 can face suspension after one qualifying conviction.
  • Failure to Appear: Missing court can result in a bench warrant and an automatic license suspension in addition to the underlying charge.

Driving while suspended can lead to a separate criminal charge. That charge may apply whether the original suspension resulted from DUI, traffic points, failure to appear, or an unresolved ticket. Addressing the original reason for the suspension doesn’t automatically dispose of the later charge.

The 30-Day DUI Suspension Hearing Deadline

A driver generally has 30 calendar days after being served with a DUI-related suspension notice to request an Administrative License Suspension hearing. Missing that deadline waives the right to a hearing and allows the suspension to take effect automatically.

The hearing request is submitted using the DDS-1206 Appeal/Hearing Request form and requires a $150 filing fee paid in full with the request. A temporary driving permit issued at the time of the DUI arrest is generally valid for 45 days, so its expiration date isn’t a substitute for the 30-day appeal deadline.

An eligible first-time offender may elect an ignition interlock device limited permit instead of requesting an Administrative License Suspension hearing. This option generally must be selected within the same 30-day period, and choosing it generally waives the hearing right. Eligibility depends on the driver’s circumstances, so this permit isn’t available in every DUI case.

Suspended License Cases in Hinesville Courts

Traffic citations issued within Hinesville city limits are heard in Hinesville Municipal Court. Offenses arising elsewhere in Liberty County are heard in the State Court of Liberty County. We have practiced in both courts since 1974 and understand the local venues that handle these matters.

Hinesville Municipal Court requires an in-person appearance for a second suspended-license offense, even if the driver has posted a cash bond. If a driver misses a scheduled Municipal Court date, the clerk notifies the Georgia Department of Driver Services to suspend that person’s driving privileges until the case is resolved. A reinstatement fee may also apply.
